NEW YORK?? A gay man and his longtime partner decide to become parents using a surrogate mother. Shortly after their son is born, the couple gets married. But there's a catch for this modern family: A will left by the man's wealthy father decrees that he must marry the mother for the child to collect an inheritance.

That quandary has prompted the man, Manhattan Criminal Court Judge Robert M. Mandelbaum, to contest the will in surrogate's court.

Mandelbaum has filed a petition on behalf of his now 2-year-old son, Cooper, that argues that a condition that might "induce the beneficiary to enter into a sham marriage of convenience" should be invalid.

The petition makes two further arguments: that Mandelbaum's partner could be considered the boy's "mother," and that excluding the boy from sharing in the family fortune would run counter to public policies protecting same-sex marriages and their offspring.

The petition portrays the father as being accepting of his son's lifestyle. But the will doesn't make clear why the father appeared to contradict that when it came to his estate.

An attorney for Mandelbaum declined comment on Thursday.

A proposed settlement reached by Mandelbaum and the guardians of two other grandchildren that would give equal stakes in a trust set up by the grandfather is pending court approval, though it could be a longshot.

Joshua S. Rubenstein, a Manhattan lawyer specializing in estate planning, said decedents have a right to shun possible beneficiaries ? whether it's because they have two fathers or because they married someone of a different race or any other reason that might sound unreasonable or even cruel.

"We might all find that repugnant, but it's your property and you can do whatever you want with it," Rubenstein said.

Mandelbaum may have "a very strong public policy argument, but the (father's) wishes may be controlling in this case," said Laura E. Stegossi, a Philadelphia estates lawyer.

The 47-year-old Mandelbaum is the son of Frank Mandelbaum, a successful Long Island businessman who died in 2007. The father was chairman and chief executive of Intelli-Check, a Woodbury, N.Y.-based maker of software that verifies the authenticity of driver's licenses and other forms of identification.

The elder Mandelbaum's will set up a trust worth hundreds of thousands for his grandchildren and their decedents. However, the will excluded any "adopted child of Robert, if adopted while Robert is a single person, or a biological child of Robert ... if Robert shall not be married to the child's mother within six months of the child's birth."

According to court documents, Mandelbaum is the biological father of Cooper, who was born in Pomona, Calif., on April, 5, 2010. The boy was conceived by using his sperm to fertilize an egg from an anonymous donor that was then implanted in the uterus of a second woman.

Mandelbaum's petition notes that a California birth certificate lists him as the "Father/Parent" and his partner, a tax lawyer, as the "Mother/Parent." The pair married in Connecticut on July 2, 2010 ? within six months of Cooper's birth.

The petition argues that the disputed provision in the will was intended only to "ensure that any children born to Robert were raised in the context of a legally recognized and committed marital relationship."

Mandelbaum's father knew his son was in a committed relationship with another man, and frequently socialized and traveled with them, the papers add.

"Thus if it was the intent of the will were to require that Robert marry a woman, the will would thereby reflect an attempt to induce the breakup of an existing family," they say. "Any will provision reflecting such an intent is likewise unenforceable as against public policy."

Microsoft revamps logo for 1st time in 25 years

SAN FRANCISCO (AP) ? Microsoft's corporate logo has a new look, setting the stage for a wave of products designed to cast the world's largest software maker in a new light.

The makeover unveiled Thursday marks the first time that Microsoft Corp. has revamped its logo since February 1987. The Internet was barely around then, and cellphones were considered a luxury.

At the time, Microsoft was putting the finishing touches on the second version of its Windows operating system. Two of Microsoft's biggest nemeses ? Google Inc. co-founders Larry Page and Sergey Brin ? were just 13 years old. And Apple Inc. co-founder Steve Jobs was just in the second year of an 11-year exile from the company that went on to invent the iPod, iPhone and iPad after he returned.

By revamping its logo, Microsoft is trying to signal that it has changed its thinking and its products to cater to people who are interacting with technology much differently than just a decade ago, let alone a quarter century.

Now, more computing tasks are being done on touch-based devices such as smartphones and tablets instead of personal computers tethered to keyboards and mice. Many software applications are now supplied over high-speed Internet connections for a monthly fee instead of being installed on individual computers.

Microsoft believes a radical change to Windows will ensure that the company survives the technological upheaval. Windows 8, due to hit the market Oct. 26, displays software applications in a mosaic of tiles and has been engineered so it works on both touch-based tablets and traditional PCs. The company also is releasing its own Windows 8-powered tablet to compete against the iPad, accompanied by a new version of Office applications tailored for such devices. There also will be a Windows 8 operating system for smartphones.

The new logo ushers in "one of the most significant waves of product launches in Microsoft's history," Jeff Hansen, the company's general manager of brand strategy, wrote in a blog post Thursday.

The redesign features the Microsoft name in a lighter, straight font called Segoe to replace the italic bold type used in the old standby. The new logo also includes the familiar red, blue, yellow and green colors used in the flag on Microsoft's Windows operating system, but the colors will be in a square box instead of the curvy template that has been in place for years. Those color boxes evoke the tiles that will be central to Windows 8.

"The ways people experience our products are our most important 'brand impressions,'" Hansen wrote. "That's why the new Microsoft logo takes its inspiration from our product design principles while drawing upon the heritage of our brand values, fonts and colors."

The new logo made its debut Thursday on Microsoft's websites, as well as three of its stores in Boston, Bellevue, Wash. and Seattle, which is located near the company's Redmond, Wash., headquarters.

This is Microsoft's fifth logo since Bill Gates and Paul Allen founded the company 37 years ago. When it last changed its logo in 1987, Microsoft had been a publicly traded company for less than a year and boasted a market value of about $2 billion. It peaked at more than $600 million in 1999. Now, Microsoft's market value stands at $254 billion ? less than half of Apple's market value of $623 billion.

Florida, Ohio, and Wisconsin Don't Like The Republican Medicare Plan

Voters in three swing states are down on the Republican plans for Medicare, but the race remains tight in a nationwide poll today. Also, Obama's maintaining something of a lead in Ohio and an even bigger one in Pennsylvania. Here's our guide to today's polls and why they matter.

Findings:?A majority of voters in three swing states ? hovering around 60 percent in each ? want Medicare to remain as it is rather than change it "to a system in which the government would provide seniors with a fixed amount of money toward purchasing private health insurance or Medicare insurance" as?Mitt Romney and Paul Ryan are proposing, according to a new poll. The Romney-Ryan option attracts less than a third of voters.

Methodology: Telephone interviews with 1,241 Florida voters, 1,253 Ohio voters, and 1,190 Wisconsin August 15 through 21 voters with a margin of error of +/-2.8 percent in all.
Why it matters: As The New York Times' Michael Cooper and Dalia Sussman?note, Medicare?got its status as a big campaign topic following the addition of Ryan to the ticket, the man "who is perhaps best known for proposing a budget plan, supported by Mr. Romney, to overhaul Medicare to rein in its costs."?These results show that regardless of whether Ryan is helping the ticket, voters in swing states are not happy with his plans for Medicare. The Hill's Daniel Strauss?puts it simply: "poll suggests Romney could be hurt on Medicare because of his selection of Ryan as his running mate."?

Caveat:?It's unclear what this exactly does. The poll shows Obama's lead has narrowed in Florida and Wisconsin, and remained the same in Ohio. Also, as The Huffington Post's Mark Blumenthal and Ariel Edwards-Levy note, the question about how voters would like to see Medicare "did not mention that Romney and Ryan support this change." Finally, nearly 50 percent of voters in each state said they would support "minor reductions" to Medicare spending to help reduce the federal deficit.

Heineken sees flat 2012 earnings after H1 decline

BRUSSELS (Reuters) - Heineken NV , the Dutch brewer battling to buy the Asian maker of Tiger beer, forecast flat earnings for the full year with emerging market growth helping to make up for a first half hit by a weak western Europe and higher input costs.

The world's third largest brewer also announced on Wednesday that it had increased its stake in Asia Pacific Breweries by 2.68 percent. Heineken is seeking to gain control of APB, with indirect and direct stake previously giving it 42 percent of the company.

A New Jersey teenager left brain-damaged after being struck by a line drive off a metal bat while he was playing in a youth baseball game will receive $14.5 million to settle his lawsuit against the bat manufacturer, Little League Baseball and a sporting goods chain.

The settlement of Steven Domalewski's lawsuit was announced in state Superior Court on Wednesday morning in Passaic County. The boy, now 18, lives in Wayne, N.J. His family had claimed the metal bat was unsafe because baseballs could carom off it at much faster speeds than wooden bats.

"The Domalewskis are still saddened by the tragic events of June 2006, but this settlement provides them with some relief and comfort that Steven will get the care he needs for the rest of his life," said the family's attorney, Ernest Fronzuto. "He still can't perform any functions of daily life on his own."

Fronzuto said the settlement precluded him from discussing its details, including whether any of the defendants admitted liability.

Domalewski was pitching when the batter rocketed a line drive off the metal bat he was swinging.

The ball slammed into Steven's chest, just above his heart, knocking him backward. He clutched his chest, then made a motion to reach for the ball on the ground to pick it up and throw to first base to get the runner out.

But he never made it that far. The ball had struck his chest at the precise millisecond between heartbeats, sending him into cardiac arrest, according to his doctors. He crumpled to the ground and stopped breathing.

His father, Joseph, a teacher who had been on the sideline with the rest of the team, said he and a third base coach from the other team both ran onto the field, where Steven was already turning blue.

Someone yelled, "Call 911!" Within 90 seconds, a man trained in cardiopulmonary resuscitation who had been playing catch with his 9-year-old daughter jumped over the fence and started to work on Steven.

Paramedics, who were a quarter-mile away doing a CPR demonstration, got to Steven within minutes, placed an oxygen mask over his face and rushed him to a hospital. But the damage had been done; his brain had been without oxygen for 15 to 20 minutes.

"Pretty much, he died," Joseph Domalewski said in a 2008 interview with The Associated Press. "It was just so fast. The thud, you could hear. When it hit him, that seemed to echo."

Domalewski was playing in a Police Athletic League game, but Little League was sued because the group certifies that specific metal bats are approved for ? and safe for ? use in games involving children.

Rick Redman, a spokesman for Hillerich and Bradsby, manufacturers of the Louisville Slugger brand bat, confirmed a settlement had been reached, but declined further comment.

An attorney representing The Sports Authority, the national sporting goods retailer, did not immediately return calls seeking comment, and an attorney who represented Little League Baseball in the case declined to comment.

Little League Baseball also did not immediately reply to messages left at its corporate headquarters.

Little League reached an agreement with the major manufacturers in the early 1990s to limit metal bats' performance to that of the best wooden bats. Little League said in 2008 that injuries to its pitchers fell from 145 a year before the accord was reached to the current level of about 20 to 30 annually.

Little League also said on its website that it has banned most metal bats for younger children for the 2012 season, although certain ones found to meet the organization's testing standards are allowed to be used. League divisions for older players can use metal bats subject to certain weight and size limits.

The Ongoing Gene Patenting Debate (And Why You Are Probably ...

An ongoing legal battle regarding gene patents began in 2009 when the ACLU representing numerous clients sued Myriad Genetics and the USPTO. The dispute is over patents on two genes, BRCA1 and BRCA2, discovered in the 1990s which have a correlation to increased rates of breast and ovarian cancer.

The case subsequently went to the Federal Appeals Court that handles biotechnology patents, the Supreme Court, and was earlier this year remanded back to the Federal Appeals Court. On August 16, 2012 the Federal Appeals Court reaffirmed that gene patents are legal. So, why did the activists lose the legal battle?

Whether you are conservative, liberal, or libertarian, or an expert or amateur patent attorney or molecular biologist; the odds are that you have objections to gene patents and made up your mind based on uniformed opinions. The Federal Appeals Court decided that these arguments are misconceptions and consequently were not very convincing. If you are an activist, do you know what a gene patent actually means? Do you know what actually receives patent protection?

In the law suit, the plaintiffs argued that gene patents violate the First Amendment and are therefore invalid and unconstitutional, because genes are products of nature. The court wisely determined everything is a product of nature, but is not always natural. Similarly, isolated BRCA genes are chemically distinct from natural DNA. That entity is a molecule, similar to the naturally occurring molecules insulin, EPO, and penicillin produced by man which have also received patent protection.??

Activists routinely refer to ownership of genes which they perceive as immoral. In patent law, however, gene patents do not convey ownership of a gene, rather are a property right guaranteed by the Constitution which temporarily excludes others from receiving financial rewards from a patent holder?s work. In addition, the Thirteenth Amendment which abolished slavery prohibits owning genes.

The plaintiffs also argued that the gene patents restrict scientific research. However, the evidence does not support this claim. A National Academy of Sciences study (2003) conducted by Walsh, Arora, and Cohen found:

"Changes in technology and policy over the last several decades have led to concerns that the patent system may be creating difficulties for those trying to perform research in biomedical fields. However, we find that drug discovery has not been substantially impeded by these changes. We also find little evidence that university research has been impeded by concerns about patents on research tools. Rather researchers managed to adopt solutions or work around the problems through licensing, going offshore, using public data, legal action, and infringement."

Furthermore, according to statistics compiled by Bloomberg News more than 18,000 scientists have researched the BRCA genes publishing more than 9,000 research papers.?

The second major dispute of the lawsuit alleges that Myriad?s $3000 screening test for mutations on the BRCA genes is too expensive and restricts access to medical care although it is covered by health insurance. However, a study conducted by Duke University researchers found that contrary to expectations, the BRCA screening test is not particularly costly relative to other tests.

The Duke study found that systemic transaction costs that exist within the medical industry are responsible for high medical costs. According to Genomics Law Report, Myriad?s revenues for the diagnostic test reached over $400 million during the company?s most recent fiscal year. Myriad?s BRCA patents are set to expire in 2015.
